Hurt in Brooklyn? We Can Help

If you were hurt in Brooklyn because someone else was careless, Mashriqi Law will handle the insurance companies, the paperwork and the deadlines while you recover. Attorney Yasmeen Mashriqi represents drivers, passengers, pedestrians, cyclists, construction workers, tenants and shoppers injured anywhere in Kings County, from Greenpoint to Coney Island.

We do not make Brooklyn clients travel to us. We meet you at home, at the hospital or by video, and our office in Queens is 20 minutes from Downtown Brooklyn when you want to sit down in person.

Call 24/7 at (718) 750-0000 or tell us what happened online. The consultation is free, and if there is no recovery you owe no fee and no case costs.

Why Brooklyn clients choose Mashriqi Law

Brooklyn is the most populous county in New York State, and the injury firms competing for its cases are mostly volume operations: a billboard, a call center and a settlement mill. We run the opposite model.

  • Direct access to your attorney, plus a dedicated case manager who returns calls the same day.
  • We come to you, anywhere in Brooklyn, or handle your case entirely by phone, video, email and e-signature.
  • Five languages spoken in-house: English, Spanish, Arabic, Farsi and Pashto, which matters in Bay Ridge, Bensonhurst, Sunset Park, Kensington and Brighton Beach.
  • 5.0 Google rating.
  • No fee unless we win, and no case costs if there is no recovery.

Injury cases we handle in Brooklyn

  • Car accidents on the BQE, the Belt Parkway, the Prospect Expressway, Atlantic Avenue, Flatbush Avenue, Ocean Parkway, Linden Boulevard and every residential street. See our New York car accident lawyer page for how no-fault and the serious-injury threshold work.
  • Truck and delivery vehicle crashes, including the box trucks and vans serving the Brooklyn Navy Yard, Sunset Park’s industrial waterfront, and the Red Hook container terminal.
  • Bus accidents involving MTA buses on routes like the B41, B46 and B35, with the MTA’s 90-day notice-of-claim deadline.
  • Pedestrian and bicycle accidents, which Brooklyn leads the city in. Vision Zero data consistently puts Atlantic Avenue, Flatbush Avenue, Eastern Parkway and Linden Boulevard among the most dangerous corridors in New York.
  • Construction accidents on the high-rise sites in Downtown Brooklyn, Williamsburg, Greenpoint and Gowanus, under Labor Law §§ 240(1), 241(6) and 200.
  • Slip, trip and fall accidents in apartment buildings, bodegas, supermarkets, subway stations and on broken or icy sidewalks, including NYCHA properties.
  • Rideshare and taxi accidents involving Uber, Lyft and TLC-licensed vehicles.
  • Wrongful death claims for families who lost someone in a preventable accident.
  • Dog bites, nursing home injuries, and inadequate security claims.

How Brooklyn injury claims work

Car, truck, bus, pedestrian and bicycle cases start with New York no-fault. The applicable auto policy pays up to $50,000 in medical bills and partial lost wages regardless of fault, provided you file within 30 days. To recover pain and suffering from the at-fault party, your injury must meet the serious-injury threshold in Insurance Law § 5102(d) — a fracture, significant disfigurement, or a permanent or significant limitation, among other categories.

Premises cases require proof that the owner or manager created the hazard or had actual or constructive notice of it. In Brooklyn, that often means obtaining building-violation histories from the Department of Buildings and HPD, and prior complaint records from NYCHA or 311.

Construction cases frequently involve strict liability under Labor Law § 240(1) against the owner and general contractor for falls and falling objects, which means your own conduct is generally not a defense. Workers’ compensation covers your employer; the Labor Law claim is against everyone else.

Claims against the City, NYCHA, the MTA or the NYC Transit Authority require a notice of claim within 90 days, a 50-h hearing if demanded, and a lawsuit within 1 year and 90 days.

Fault in Brooklyn injury cases: the 2026 change

For lawsuits started on or after May 26, 2026, under CPLR § 1411(b), a plaintiff found more at fault than the defendants cannot recover. If your share is not greater than theirs, your award is reduced by your percentage of fault.

Brooklyn juries are fair, but insurers know this rule gives them a new lever. Insurance adjusters will push hard for a recorded statement in the first 48 hours in hopes of getting you to say something that shifts blame. Do not give one. Give it to us instead.

What your Brooklyn case may be worth

New York allows recovery for:

  • Medical expenses, past and future, beyond what no-fault paid
  • Lost wages and lost earning capacity
  • Pain and suffering and loss of enjoyment of life
  • Scarring and disfigurement
  • Property damage
  • In wrongful death cases, funeral expenses and the family’s lost financial support

Case value depends on the permanence of your injury, your treatment history, your income and the available insurance. Tell us about your case with the Personal Injury Calculator and we will give you a realistic view.

How we build a Brooklyn case

  1. Preservation letters go out within days to the at-fault party, the vehicle owner, nearby businesses and the City, so video and vehicle data are not destroyed.
  2. Evidence collection: the NYPD report (precincts 60 through 94), ambulance call report, FDNY records, DOT signal timing where relevant, DOB and HPD violations in premises cases, OSHA and site-safety logs in construction cases.
  3. Every insurance policy: liability, owner liability under VTL § 388, commercial fleet policies, your SUM coverage, MVAIC for hit-and-runs, building and contractor policies.
  4. Medical documentation that shows what your injury is, that it is permanent, and that it came from this accident and not an earlier one — the three things insurers attack.
  5. Trial preparation from day one, in the Kings County Supreme Court at 360 Adams Street. Firms that try cases get better settlements.

What to do after an injury in Brooklyn

  1. Get medical care immediately; gaps in treatment cost you money later.
  2. Report it (911, building management, your employer) and keep the report number.
  3. Photograph the scene, the hazard, the vehicles and your injuries.
  4. Collect witness names and numbers.
  5. No recorded statements to the other side’s insurer.
  6. For vehicle accidents: no-fault application within 30 days; MV-104 to DMV within 10 days.
  7. Call a Brooklyn personal injury lawyer before signing anything.

Deadlines for Brooklyn injury claims

  • Most personal injury lawsuits: 3 years
  • Claims against NYC, NYCHA, MTA or NYCTA: notice of claim 90 days, suit 1 year and 90 days
  • Wrongful death: 2 years
  • Medical malpractice: 2 years 6 months
  • No-fault application: 30 days

Brooklyn personal injury FAQs

How much does a Brooklyn personal injury lawyer cost?

Nothing up front. Contingency only. No recovery, no fee, no case costs.

Your office is in Queens. Can you handle a Brooklyn case?

Yes. We appear in Kings County Supreme Court regularly, and we meet Brooklyn clients at home, at the hospital or by video.

How long do I have to sue in Brooklyn?

Generally 3 years. 90-day notice of claim if the City, NYCHA or the MTA is involved. 2 years for wrongful death.

I was hit by a car while walking in Brooklyn. Who pays my medical bills?

No-fault from the policy on the vehicle that hit you, or from a policy in your own household. You can also sue the driver if your injury is serious.

I fell in my NYCHA building. Is that a case?

Possibly. NYCHA is a public authority, so a notice of claim is due within 90 days. Prior complaint records about the hazard are key.

What if I was partly at fault?

Under New York’s 2026 fault rule, you can still recover if you were not more at fault than the defendants, reduced by your share.

Do you speak Spanish or Arabic?

Yes. Spanish, Arabic, Farsi and Pashto, in-house.

Should I take the insurance company’s first offer?

Almost never. First offers come before anyone knows the full extent of your injury, and a signed release ends your claim.
