How Long Island injury claims work

Vehicle accidents start with New York no-fault: up to $50,000 in medical bills and partial lost wages from the applicable auto policy regardless of fault, filed within 30 days. Pain and suffering requires a serious injury under Insurance Law § 5102(d) and a claim against the at-fault driver.

Premises accidents require proof that the owner created the hazard or knew or should have known about it. On Long Island that often means snow-and-ice records, maintenance logs and prior complaints.

Construction accidents frequently involve strict liability under Labor Law § 240(1) against the owner and general contractor, beyond workers’ compensation.

Claims against a county, town, village, school district or bus system require a notice of claim within 90 days to the correct entity, a 50-h hearing if demanded, and a lawsuit within 1 year and 90 days. Nassau County, the Towns of Hempstead, North Hempstead and Oyster Bay, the Cities of Glen Cove and Long Beach, Suffolk County, its ten towns and dozens of villages each own roads and vehicles and each has its own notice rules. Filing with the wrong one is the same as not filing. We identify who owns what and file correctly.

The 2026 fault rule

For lawsuits started on or after May 26, 2026, under CPLR § 1411(b), a plaintiff found more at fault than the defendants cannot recover; otherwise damages are reduced by the plaintiff’s share. Do not give the other side’s insurer a recorded statement.

What your Long Island case may be worth

Medical expenses past and future, lost wages and earning capacity, pain and suffering, loss of enjoyment of life, scarring and disfigurement, emotional distress, property damage and, in fatal cases, wrongful death damages. Value depends on permanence, treatment, income and insurance. Use the Personal Injury Calculator for a realistic range.

How we build a Long Island case

  1. Preservation letters within days to every responsible party and the municipality.
  2. Evidence collection: Nassau County Police, Suffolk County Police, town or village PD or State Police report; ambulance call report; medical records; maintenance and violation records in premises cases; OSHA and site-safety records in construction cases.
  3. Every insurance policy: liability, owner liability under VTL § 388, commercial, SUM, MVAIC, building and contractor policies.
  4. Medical documentation showing what the injury is, that it is permanent, and that this accident caused it.
  5. Trial preparation from day one in the Nassau County Supreme Court in Mineola or the Suffolk County Supreme Court in Riverhead or Central Islip.

What to do after an injury on Long Island

  1. Get medical care immediately.
  2. Report it: 911 for a crash, management for a fall, your employer for a work injury. Keep the report number.
  3. Photograph the scene, the hazard, the vehicles and your injuries.
  4. Collect witness names and numbers.
  5. No recorded statements to the other side’s insurer.
  6. For vehicle accidents: no-fault within 30 days, MV-104 within 10 days.
  7. Call a Long Island personal injury lawyer before signing anything.

Long Island personal injury FAQs

Your office is in Queens. Can you handle my Long Island case?

Yes. We appear in Mineola, Riverhead and Central Islip regularly and meet Long Island clients at home, at the hospital or by video.

How much does a Long Island personal injury lawyer cost?

Nothing up front. Contingency only: no recovery, no fee, no case costs.

How long do I have to sue on Long Island?

Generally 3 years. 90-day notice of claim if a county, a town, a village or a school district is involved. 2 years for wrongful death.

I was hurt at a town beach, park or on a town road. What applies?

A notice of claim to that town within 90 days. We identify the right entity and file.

What if I was partly at fault?

Under New York’s 2026 fault rule, you recover if you were not more at fault than the defendants, reduced by your share.

I fell on ice in a shopping center parking lot. Is that a case?

Often, yes, if the owner or its snow contractor failed to clear it in a reasonable time. Weather records and maintenance logs decide it.

Do you speak Spanish?

Yes. Spanish, Arabic, Farsi and Pashto, in-house.

Should I take the insurance company’s first offer?

Almost never. First offers come before anyone knows the full extent of your injury, and a signed release ends your claim.
